Please read carefully and sign before your session date
This Client Agreement is between you (the client) and Bibi Portraits, operated by Roserbie Theoc under JEDAIAH LLC, Miami, Florida. By signing below you confirm that you have read, understood, and agree to all terms in this agreement. Your electronic signature is legally binding under the Florida Electronic Signature Act and the federal ESIGN Act.
You have booked a luxury portrait session with Bibi Portraits at the private Miami studio. Your session date and wardrobe consultation date are confirmed by email. The studio address is provided by email and is not to be shared publicly.
Your $750 retainer is non-refundable and has been credited toward your chosen session package. Full balance is due no later than the day before your session date. If full payment is not received by this deadline, your session may be cancelled without refund of the retainer.
If you selected a full-pay package at time of booking, your payment is complete and your upgrade benefit has been noted for fulfillment at time of image delivery.
One reschedule is permitted with a minimum of 72 hours notice before your session date. Rescheduling requests made with less than 72 hours notice will result in forfeiture of the retainer. Cancellations at any time result in forfeiture of the retainer. No refunds are issued on paid session balances.
Your fully retouched portraits will be delivered within 2-3 weeks of your session date. All images are delivered in both print quality (300 DPI) and social media format at no additional charge. Physical folio boxes and custom albums are handcrafted to order and may require additional time within the 2-3 week window.
By signing this agreement, you grant Bibi Portraits (Roserbie Theoc / JEDAIAH LLC) a non-exclusive, royalty-free license to use your session images for the following purposes:
Bibi Portraits will never use your images in a way that is degrading, misleading, or inconsistent with the spirit of the session. Your name will not be used in advertising without your prior written consent.
If you wish to restrict the use of your images for any or all of the above purposes, you must notify Bibi Portraits in writing before your session date. A restricted use session may be subject to a different pricing structure. Failure to notify us before the session date constitutes agreement to the standard model release terms above.
All photographs taken during your session are the intellectual property of Roserbie Theoc. You are granted a personal, non-commercial license to use your delivered portraits for personal purposes including printing, framing, and sharing on personal social media accounts with credit to @BibiPortraits.
You may not sell, license, commercially reproduce, or use your portraits for any commercial purpose without prior written consent from Bibi Portraits.
The session environment is private and intimate. Unapproved guests are not permitted. Any conduct that is disrespectful, threatening, or inappropriate may result in the session being ended early without refund. The studio address is confidential and must not be shared publicly.
Bibi Portraits liability to you is limited to the amount paid for your session. We are not liable for indirect or consequential damages. In the event of equipment failure or emergency preventing session completion, Bibi Portraits will reschedule your session or issue a credit — at our discretion.
This agreement is governed by the laws of the State of Florida. Any disputes shall be resolved in Miami-Dade County, Florida.
